Terms of Service

These Terms of Service ("Terms") govern your use of Beyond the Job, including our website, mobile application, digital resources, training activities, guidance, tools and related services (together, the "Service").

The Service is provided by Beyond the Job ("Beyond the Job", "we", "us" or "our").

By accessing or using the Service, you agree to comply with these Terms.

If you do not agree with these Terms, you should not access or use the Service.

1. How Beyond the Job Works

Beyond the Job provides digital resources and tools designed to support apprentices with their off-the-job training.

Access to the Service is provided through participating training providers.

Training providers purchase licences from Beyond the Job and may allocate those licences to eligible apprentices.

Apprentices do not purchase access to Beyond the Job directly.

A training provider may determine which of its apprentices are provided with access to the Service, subject to the terms of its agreement with Beyond the Job.

2. Training Provider Customers

Training providers that purchase access to Beyond the Job are responsible for:

  • purchasing the appropriate number of licences
  • allocating licences to eligible apprentices
  • ensuring that users accessing the Service through their organisation are authorised to do so
  • maintaining accurate information where required
  • complying with the Training Provider Terms & Conditions
  • ensuring that their use of the Service complies with applicable laws and regulations

The commercial relationship between Beyond the Job and a training provider is governed by the applicable Training Provider Terms & Conditions.

Where there is a conflict between these Terms and the Training Provider Terms & Conditions, the Training Provider Terms & Conditions will take precedence in relation to the commercial relationship between Beyond the Job and the training provider.

3. Apprentice and Learner Users

Apprentices may access Beyond the Job where their training provider has provided or authorised access.

Apprentices are not required to purchase a licence directly from Beyond the Job.

An apprentice's access may depend on:

  • their training provider having an active arrangement with Beyond the Job
  • their training provider having an available licence
  • the apprentice remaining eligible for access
  • compliance with these Terms

An apprentice may not transfer their access to another person.

4. User Accounts

Users must provide accurate information when creating an account and must keep their account information up to date where reasonably required.

Users are responsible for keeping their login credentials confidential.

You must not:

  • share your account with another person
  • allow another person to use your login credentials
  • create an account using another person's identity
  • attempt to access another user's account
  • provide false or misleading information

If you believe that your account has been compromised, you should notify Beyond the Job or your training provider as soon as reasonably possible.

5. Training Provider Management of Access

Training providers may be responsible for managing the access of apprentices using their allocated licences.

A training provider may request that access is:

  • created
  • amended
  • transferred
  • suspended
  • removed

Beyond the Job may act on legitimate requests from an authorised representative of a training provider.

Where an apprentice leaves a training provider, completes their programme or is otherwise no longer eligible for access, the training provider may request that their access is removed or transferred in accordance with the provider's agreement with Beyond the Job.

6. What Beyond the Job Provides

The Service may include:

  • off-the-job training activity ideas
  • learning resources
  • guides
  • checklists
  • templates
  • tools
  • development activities
  • information relating to apprenticeship standards
  • resources relating to Knowledge, Skills and Behaviours ("KSBs")
  • progress and activity-recording functionality
  • other resources and features introduced by Beyond the Job

We may add, change or remove features from the Service from time to time.

7. Educational Purpose

Beyond the Job is designed to support apprentices and training providers with off-the-job training.

The Service is intended to complement, rather than replace:

  • training provider delivery
  • teaching
  • assessment
  • coaching
  • mentoring
  • employer support
  • apprenticeship programme requirements
  • end-point assessment preparation

Beyond the Job does not determine whether an apprentice has completed their required off-the-job training.

Training providers and employers remain responsible for making appropriate decisions regarding an apprentice's training programme and progress.

8. Apprenticeship Standards and KSBs

Beyond the Job may contain resources that reference apprenticeship standards, Knowledge, Skills and Behaviours ("KSBs") and other apprenticeship requirements.

These resources are designed to help users identify relevant learning and development opportunities.

Apprenticeship standards and associated requirements may change over time.

Although we aim to keep our content accurate and relevant, we cannot guarantee that every resource will always reflect the most recent version of an apprenticeship standard.

Training providers should refer to the applicable official apprenticeship standard and current programme requirements when making formal decisions about an apprentice's programme.

9. No Guarantee of Evidence or Compliance

The inclusion of an activity or resource within Beyond the Job does not guarantee that the activity:

  • will be accepted as off-the-job training in every circumstance
  • will be accepted as evidence by a particular training provider
  • will satisfy an employer
  • will satisfy an end-point assessment organisation
  • will satisfy an auditor or external quality assurance organisation
  • will meet every requirement of a particular apprenticeship programme

Training providers remain responsible for determining whether activities are appropriate for their apprentices and programmes.

10. Acceptable Use

You must use Beyond the Job responsibly and lawfully.

You must not:

  • use the Service for unlawful purposes
  • attempt to gain unauthorised access to the Service or another user's account
  • share your account with another person
  • copy or redistribute Beyond the Job content without permission
  • sell or commercially exploit Beyond the Job content without permission
  • scrape or systematically extract content from the Service
  • attempt to bypass security or access controls
  • introduce viruses, malware or other harmful material
  • interfere with the operation or security of the Service
  • reverse engineer the Service except where permitted by law
  • impersonate another person or organisation
  • use the Service to harass, threaten or abuse another person
  • upload unlawful, defamatory, discriminatory or otherwise inappropriate content
  • use the Service in a way that could damage Beyond the Job, its users or its reputation

We may suspend or restrict access where we reasonably believe these rules have been breached.

11. Intellectual Property

All intellectual property rights in Beyond the Job belong to Beyond the Job or our licensors unless otherwise stated.

This includes:

  • the Beyond the Job name and branding
  • logos
  • website and application design
  • written content
  • training activities
  • learning resources
  • guides
  • checklists
  • templates
  • graphics
  • photographs
  • videos
  • software
  • databases
  • functionality
  • the structure and organisation of the Service

Nothing in these Terms transfers ownership of our intellectual property to you or your organisation.

Subject to these Terms and the applicable Training Provider Terms & Conditions, users are granted a limited, non-exclusive, non-transferable and revocable right to access and use the Service for its intended purpose.

12. Training Provider Use of Content

Training providers may use Beyond the Job resources through the Service for the purpose of supporting apprentices who have been allocated valid licences.

Unless expressly permitted in writing, training providers must not:

  • reproduce the entire Beyond the Job resource library
  • copy resources into another platform
  • distribute resources to unlicensed apprentices
  • sell or sublicense Beyond the Job content
  • make Beyond the Job resources available to third parties
  • modify and redistribute Beyond the Job content as their own

Specific licensing rights may be agreed separately between Beyond the Job and a training provider.

13. User-Generated Content

Some features may allow users to enter information, notes, responses, reflections or other material into the Service ("User Content").

Users retain ownership of their User Content.

By submitting User Content, you grant Beyond the Job a non-exclusive, worldwide, royalty-free licence to store, process, reproduce and use that content where reasonably necessary to operate, maintain and improve the Service.

Users are responsible for ensuring that they have the right to submit any User Content they provide.

Users must not submit information that:

  • they do not have permission to share
  • infringes another person's intellectual property rights
  • is unlawful
  • contains malicious code
  • breaches these Terms

14. Personal Information

Beyond the Job may process personal information relating to users of the Service.

Our Privacy Policy explains how we collect, use, store and protect personal information.

Where an apprentice accesses Beyond the Job through a training provider, the training provider may provide certain information to Beyond the Job to enable the account to be created and managed.

Depending on the circumstances, Beyond the Job and the training provider may have separate responsibilities in relation to personal data.

Where applicable, the parties' responsibilities will be set out in the relevant contractual arrangements and privacy documentation.

15. Service Availability

We aim to keep Beyond the Job available and operating reliably.

However, we do not guarantee that the Service will always:

  • be available
  • operate without interruption
  • be free from errors
  • be compatible with every device
  • remain unchanged
  • be free from technical issues

We may temporarily suspend or restrict access where reasonably necessary for:

16. Third-Party Services

Beyond the Job may use third-party services, including hosting providers, payment providers, authentication services, app stores, analytics providers and other technology providers.

Third-party services may have their own terms and privacy policies.

We are not responsible for services provided by third parties that are outside our reasonable control.

17. External Links

The Service may contain links to external websites or resources.

These links may be provided for convenience or educational purposes.

Beyond the Job does not control third-party websites and is not responsible for their content, availability, security or privacy practices.

18. Security

We take reasonable steps to protect the Service and information processed through it.

However, no online service can be guaranteed to be completely secure.

Users and training providers are responsible for maintaining appropriate security measures for their accounts and devices.

Any suspected security issue should be reported to Beyond the Job as soon as reasonably possible.

19. Suspension or Termination of Access

We may suspend or terminate a user's access where we reasonably believe that:

  • these Terms have been breached
  • the Service is being misused
  • an account is being used by an unauthorised person
  • there is a security risk
  • the user has engaged in unlawful activity
  • we are required to do so by law

A training provider's access may also be suspended or terminated in accordance with its Training Provider Terms & Conditions.

Where appropriate, Beyond the Job may provide an opportunity to remedy a breach before access is terminated.

20. End of Training Provider Access

If a training provider's agreement with Beyond the Job ends, the access provided to apprentices through that provider may also end.

Where appropriate, Beyond the Job may allow a training provider or its apprentices a reasonable period to transition away from the Service.

The specific rights of the training provider following termination will be governed by the applicable Training Provider Terms & Conditions.

21. Disclaimer

Beyond the Job is provided to support learning and development.

While we take reasonable steps to ensure that our resources are useful and accurate, we do not guarantee that the Service will be completely accurate, complete or suitable for every user or apprenticeship programme.

Users and training providers should use their own professional judgement when using the Service.

22. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

Subject to applicable law, Beyond the Job will not be responsible for losses arising from:

  • misuse of the Service
  • reliance on information where the user or training provider should reasonably have verified that information
  • decisions made by a training provider, employer or apprentice based on resources within the Service
  • third-party services outside our reasonable control
  • failure to maintain appropriate account security
  • circumstances outside our reasonable control

Additional liability provisions applying specifically to training providers may be contained within the Training Provider Terms & Conditions.

23. No Guarantee of Apprenticeship Outcomes

Use of Beyond the Job does not guarantee:

  • successful completion of an apprenticeship
  • achievement of an apprenticeship standard
  • successful completion of an end-point assessment
  • acceptance of evidence by an assessment organisation
  • improved assessment results
  • employment
  • promotion
  • any other particular outcome

Apprenticeship outcomes depend on many factors outside Beyond the Job's control.

24. Changes to the Service

We may update, improve, replace or remove features of the Service from time to time.

We may also update resources to reflect:

  • changes to apprenticeship standards
  • changes to legislation
  • changes to technology
  • user feedback
  • developments in education and training

Where a change materially affects a contractual arrangement with a training provider, the relevant Training Provider Terms & Conditions will apply.

25. Changes to These Terms

We may update these Terms from time to time.

The latest version will be made available through our website or Service.

Where we make a material change, we will take reasonable steps to notify affected users where appropriate.

Your continued use of the Service after updated Terms come into effect may constitute acceptance of those Terms where permitted by law.

26. Complaints

If you have a complaint about Beyond the Job or the Service, please contact us using the contact details provided on our website.

We will aim to investigate complaints and respond within a reasonable period.

Where an apprentice has a concern specifically relating to their apprenticeship programme, assessment or training provision, they should normally raise that concern with their training provider in the first instance.

27. Events Outside Our Control

We will not be responsible for a failure or delay in providing the Service where this results from circumstances beyond our reasonable control.

This may include:

  • significant internet or telecommunications failures
  • power failures
  • cyberattacks affecting third-party infrastructure
  • natural disasters
  • government action
  • industrial disputes
  • war or civil unrest
  • serious technical failures
  • failures of third-party providers

28. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A failure by us to enforce a right under these Terms does not mean that we have waived that right.

You may not transfer your rights or obligations under these Terms without our written permission, except where permitted by law.

We may transfer our rights and obligations as part of a business sale, restructuring or similar transaction.

29. Governing Law

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have jurisdiction over disputes arising from these Terms, subject to any mandatory legal rights that apply to the individual user or organisation concerned.
